Tzvi Wertheimer Counseling is a solo licensed mental health counseling practice in Brooklyn, New York. This policy explains how the practice handles the personal and mobile information of the people it works with. It is written to be read, not to be waved at.

What is collected

The practice collects only what it needs in order to provide care and to run itself: a client's name, date of birth, address, telephone numbers, email address, insurance details where relevant, and the clinical record of their care. Contact details are given by the client themselves, at registration or afterwards.

No information is bought from anybody, and no list of contact details is obtained from any third party.

Text messages and your mobile number

A client gives their mobile number to the practice directly, and agrees in writing to be contacted by text, by signing the practice's Permission to Communicate by Text Message form. Text messages are used for appointment reminders, scheduling changes and administrative correspondence.

Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.

Mobile numbers and the content of text messages are handled by the practice's messaging provider solely in order to deliver those messages. They are not passed to advertisers, data brokers, or any other third party for marketing, and the practice sends no marketing messages of any kind.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to stop receiving them, or HELP for help. Agreeing to text messages is never a condition of receiving services, and a client who declines, or who stops later, is contacted by telephone instead.

Health information

Clinical records are protected health information and are handled under HIPAA and New York State law. Every client is given the practice's Notice of Privacy Practices, which sets out in full how that information may be used and disclosed and what rights a client has over it. That notice is provided at registration and is available from the practice at any time.

Health information is not disclosed to anybody outside the practice except as that notice describes — with the client's written authorization, for treatment, payment or health care operations, or where the law requires it.

Who else handles this information

The practice uses a small number of service providers to store records and to carry telephone calls and text messages. Each is used only to do that work on the practice's behalf. None of them is permitted to use the information for their own purposes, and none is given it for marketing.

Keeping it

Clinical records are kept for as long as professional licensing and state law require. Contact details are kept while somebody is a client of the practice and for as long as the record itself is kept.

Your choices

• Ask what the practice holds about you, and ask for a copy.
• Ask for a correction to anything that is wrong.
• Stop text messages at any time, by replying STOP or by asking.
• Choose how the practice contacts you, and change your mind later.
